1. Headline position — Toker does not deliver cannabis

Toker does not deliver, ship, courier, or arrange delivery of cannabis or any cannabis product. Toker is an information directory, a marketing platform, and a seller of Toker-branded merchandise. The only non-physical product Toker sells is a digital entitlement called a Day Pass, which is delivered electronically (over the internet) to the buyer's account. Toker-branded merchandise (e.g. t-shirts, accessories) is sold by Toker and delivered by an independent third-party courier engaged by Toker — see §6 below. Toker does not hold inventory, does not take title to the merchandise, and does not perform the delivery in-house.

Toker does not deliver cannabis. Toker does not arrange cannabis delivery on behalf of any shop. Toker does not coordinate with any third-party delivery service for cannabis. Any delivery of cannabis to an end user is a matter strictly between that user and a licensed shop under the shop's own licence and the shop's own delivery policy.

2. The Day Pass is a digital entitlement — not a physical product

A Day Pass is a digital entitlement purchased by you from Toker through the Platform. The Day Pass grants you access to a particular shop's premises for 24 hours from the time of purchase. The Day Pass is a service (entitlement to access a venue), not a product.

On purchase:

  • A unique Day Pass code is generated server-side and stored against your account
  • The Day Pass appears in your in-app wallet at /dashboard/client/day-passes
  • The shop is notified (only your first name and first letter of surname + the code)
  • Your purchase record (code, amount, date) is available from your wallet at /dashboard/client/day-passes; no separate email receipt is sent

No physical item is shipped. No courier is dispatched. No shipping address is required for a Day Pass purchase.

3. Day Pass validity

A Day Pass is valid for 24 hours from the moment of purchase. It does not expire at midnight and is not tied to a calendar day: a Day Pass bought at 22:00 remains valid until 22:00 the following day. Validity runs from the purchase timestamp recorded by the Platform, and the exact expiry time is shown on your pass. Valid only at the shop for which it was issued.

4. Shop-side delivery is the shop's own policy

Some shops may, at their option, offer a delivery service to their own customers under their own cannabis licence, their own delivery policy, and their own compliance with the Cannabis for Private Purposes Act 37 of 2024 and any other applicable South African law. Where a shop offers delivery, the delivery is:

  • NOT arranged by Toker
  • NOT paid for through Toker
  • NOT tracked or verified by Toker
  • NOT covered by Toker's Refund Policy (that policy covers what Toker itself sells — Day Passes and Toker-branded merchandise — not a shop's own delivery of its own goods)
  • NOT endorsed or recommended by Toker

Any dispute about a shop's delivery (timing, quality, ID checks, age verification, lost delivery, etc.) is a dispute between you and the shop. Toker is not a party to that dispute and will not mediate it. If you wish to complain about a shop's delivery, address the complaint to the shop directly; if unresolved, refer it to the National Consumer Commission (see the Contact page).

5. Shipping zones, costs, and timeframes

For the Day Pass and any other digital entitlement sold by Toker, this section is intentionally not applicable. The Day Pass is delivered electronically to your account within seconds of a successful payment; there are no shipping zones, no shipping costs, and no shipping timeframes.

For Toker-branded merchandise, the specific shipping zones, costs, and timeframes are published on the relevant product page at the time of listing — see §6 below. Toker does not manage the courier network directly; delivery is performed by an independent third-party courier engaged by Toker.

6. Delivery of Toker-branded merchandise

Toker sells Toker-branded merchandise (e.g. t-shirts, accessories) through the Platform. Merchandise is not cannabis and is not a cannabis product — it is Toker-branded apparel and accessories. Where merchandise is offered, the specific delivery terms (courier, timeframes, costs, return policy) are published on the relevant product page at the time of listing. Merchandise is delivered by an independent third-party courier engaged by Toker; Toker does not perform the delivery in-house.

The fulfilment model is dropship: Toker markets and sells the merchandise but a third-party holds the inventory and ships directly to the customer. The merchandise production chain (e.g. printing, embroidery, customisation) is provided by a dropservice partner. Toker is the seller of record for the customer-facing transaction; the dropship and dropservice partners are Toker's suppliers, not the customer's contracting party.

Risk and ownership of the merchandise pass to the courier on collection from the dropship partner's facility, and from the courier to the customer on delivery to the address supplied at checkout. Lost, damaged, or delayed shipments are the courier's responsibility under their own terms; Toker acts as the customer's point of contact to resolve the issue with the courier — see also the Refund Policy §14 (Merchandise refunds and returns).

7. Failure to deliver / lost delivery

For the avoidance of doubt: Toker's only deliverable is a digital entitlement delivered electronically to your account. There is no courier, no waybill, and no physical item that can be "lost in transit". If a Day Pass does not appear in your account after a successful payment, this is a payment-processor error (see Refund Policy §2 — Payment processor error), not a delivery failure, and is fully refundable.

8. Changes to this policy

Material changes are posted on the Platform with 30 calendar days' notice.
