This Acceptable Use Policy sets out the rules that apply to every person who uses the Toker Platform. By using the Platform you agree to it. It is incorporated by reference into the User Agreement and the Shop Owner Agreement.

1. Scope

This AUP governs your conduct on go-toker.com, the PWA, the API, and any communications from Toker. It does not govern your conduct at any shop you discover on the Platform — that is governed by the shop's own policies and by South African law.

2. Prohibited content

2.1 Unlawful under South African law

  • Incitement to violence or commission of any crime
  • Hate speech (Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000; Films and Publications Act 65 of 1996)
  • Child pornography (reported immediately to SAPS)
  • Intellectual-property infringement (Copyright Act 98 of 1978)
  • Defamation
  • Breach of any court order
  • Obscene, indecent, or offensive material

2.2 Unlawful cannabis marketing

Because Toker is an information directory and does not sell or promote cannabis, you may not submit any content that:

  • Markets or advertises cannabis for sale
  • Lists specific cannabis strains, products, SKUs, or quantities for sale
  • Lists prices for cannabis or any cannabis product
  • Depicts cannabis buds, cannabis products, or cannabis paraphernalia for the purpose of marketing
  • Makes therapeutic or medical claims about cannabis (regulated by SAHPRA)
  • Targets minors in any cannabis-related messaging

2.3 Abusive or harassing

  • Threats, intimidation, harassment, or bullying
  • Targeting on the basis of race, gender, gender identity, sexual orientation, religion, disability, or any ground listed in section 1 of the Employment Equity Act 55 of 1998
  • Impersonation of any other person or entity
  • Revealing another person's personal information without their consent (POPIA s.6)

2.4 Promotional or commercial (outside the Platform)

  • Spam, advertisements, or promotional material for any third-party product or service not sold through the Platform
  • Affiliate links, tracking pixels, or referral codes
  • Solicitations for employment, investment, or any other off-platform transaction

2.5 Technical abuse

  • Viruses, worms, trojan horses, ransomware, or any malicious code
  • Automated scraping, crawling, or data-mining of the Platform (use the published API within rate limits)
  • Bypassing, circumventing, or attempting to circumvent any rate limit, access control, or security feature
  • Reverse-engineering the Platform except to the extent permitted by law
  • Forged or spoofed requests

2.6 Fraudulent transactions

  • Using a payment instrument that does not belong to you
  • Colluding to create fictitious check-ins, ratings, or Day Pass purchases
  • Money laundering (FICA 38 of 2001)

3. Prohibited conduct

In addition to the prohibited content above, you may not:

  • Register more than one personal account
  • Create a shop listing for a shop you do not own or operate
  • Provide false identity documents to Toker's verification team
  • Impersonate Toker staff, the Information Officer, or any other person
  • Publicly disparage Toker in a defamatory manner
  • Use the Platform to plan or facilitate any unlawful act

4. Shop-specific prohibitions

If you are a shop owner, you also agree not to:

  • List a shop at an address where you do not actually operate
  • List operating hours you do not actually honour
  • Charge a Day Pass holder any additional fee to enter your premises on the day of the Pass
  • Resell, transfer, or re-issue a Day Pass
  • Pressure, bribe, or coerce a client regarding a rating they have left
  • Run an unauthorised lottery, gambling, or competition from your listing

5. Reporting

If you believe content breaches this AUP, report it to:

We acknowledge your report within 5 business days and respond substantively within a reasonable time.

6. Enforcement

Where we determine, in our reasonable discretion, that you have breached this AUP, we may:

  • Remove the offending content
  • Issue a warning
  • Suspend your account or shop
  • Terminate your account or shop
  • Reverse any fraudulent transaction
  • Report the matter to the South African Police Service, the National Consumer Commission, the Information Regulator, or any other competent authority

6.1 Appeal

You may appeal an enforcement action by emailing legal@go-toker.com within 14 calendar days. We respond within 30 calendar days.

6.2 Counter-notification

If you believe content we removed was not in breach, you may submit a counter-notification to legal@go-toker.com containing your full name, address, telephone, email, identification of the content, a statement under oath that you have a good-faith belief the removal was in error, and consent to the jurisdiction of the South Gauteng High Court, Johannesburg.
